    Dato Mah Weng KwaiTan Sri James Foong Cheng Yuen

    DATO' MAH WENG KWAI

    Dato’ Mah Weng Kwai was called to the English Bar as a Barrister-at-Law in 1971 and to the Malaysian Bar as an advocate and solicitor of the High Court of Malaya in July 1972.

    In 1973 Dato’ Mah joined the Judicial and Legal Services of Malaysia and held, inter alia, the posts of Magistrate, President of the Sessions Court and Senior Assistant Registrar of the High Court. He also served as a Deputy Public Prosecutor and Senior Federal Counsel in the Attorney General’s Chambers.

    Dato’ Mah obtained his Master of Laws degree with Honours in 1985 from the University of Sydney, Australia and in 1999 was appointed a Fellow of the Senate of the University of Sydney.

    He left the Judicial and Legal Services in 1985 and commenced private practice as an advocate and solicitor as the principal of Mah Weng Kwai & Associates.

    Dato’ Mah is a past president of the Malaysian Bar and of the Law Association for Asia and the Pacific (LAWASIA). He was also a member of the Legal Profession Qualifying Board and the Advocates and Solicitors Disciplinary Board both established under the Legal Profession Act 1976.

    On Jan. 4, 2010, Dato’ Mah was appointed a Judicial Commissioner of the High Court of Malaya and on Aug. 10, 2011, a Judge of the High Court of Malaya in Kuala Lumpur. He was elevated to the Court of Appeal, Malaysia on Sept. 21, 2012.

    Dato’ Mah returned to MahWengKwai & Associates as a consultant after his retirement as a Court of Appeal Judge in February 2015. He is on the Kuala Lumpur Regional Centre for Arbitration's panel of arbitrators and is certified as a mediator by the Malaysian Mediation Centre. 

    TAN SRI JAMES FOONG CHENG YUEN  

    Tan Sri James Foong Cheng Yuen was called to the English Bar by the Honourable Society of the Inner Temple in 1970 and to the Malaysian Bar in 1971.

    From 1971 to 1990, Tan Sri James Foong engaged in private legal practice as an advocate and solicitor specializing in criminal and insurance law. He was appointed Judicial Commissioner of the High Court of Malaya in 1990 and in 1992 was elevated to the High Court Bench. He then advanced to the Court of Appeal of Malaysia in 2005 and became a Federal Court Judge in 2009.

    While still a Federal Court Judge, Tan Sri James Foong was appointed Managing Judge of the Civil Division of the High Court in Kuala Lumpur and of the High Court and subordinate courts in the state of Penang.

    He retired from the Malaysian judiciary on February 25, 2012. He was made a Bencher of the Honorable Society of the Inner Temple, London in 2009 and in March 2011 was conferred an Honorary Doctorate of Laws by the University of the West of England.

    Currently, Tan Sri James Foong is an arbitrator of the International Court of Arbitration of the International Chamber of Commerce and the Kuala Lumpur Regional Centre for Arbitration, a senior consultant to the China ASEAN Legal Cooperation Centre based in Hainan, People's Republic of China, an advocate and solicitor of the High Court of Malaya and a director of a number of companies.

     ALB MALAYSIA LAW AWARDS 2015

    METHODOLOGY SUMMARY

      Part I

    GENERAL GUIDELINES

     A. All nominations must be written in the ALB nomination form. The same must be submitted not later than Jan. 28, 2015. ALB will not accept entries written in any other forms.

     

    B. Entries for any categories must have been completed between Dec. 1, 2013 to Nov. 30, 2014.

     

    C. Documents supplementary to the information provided in the nomination form may be submitted within the nomination period. No supplementary information will be accepted after the nomination deadline.

     

    D. Clients or contact persons provided in the nomination form will be contacted by ALB, as may be necessary, without prior notice to the nominating organisation. It is advisable that only clients whose consent for this purpose has been obtained are listed in the nomination form.

     

    E.  Foreign law firms advising Malaysian parties on matters pertaining to non-Malaysian laws may join the nominations, unless otherwise provided in the succeeding provisions.

     

    F. A third-party nomination for Dealmaker of the Year, In-House Lawyer of the Year or Managing Partner of the Year can be considered only when the nominee's law firm or in-house team has not nominated for such individual category.

     

    Part II 

    DEFINITION OF TERMS

     

    For purposes of this Awards, unless the context otherwise requires -

     

    "breadth" means the degree to which the work spanned different jurisdictions, practice areas, parties and industries;

     

    "complexity" means the degree to which the work requires intricate legal principles or advanced techniques and structures;

     

    "impact or significance" means the degree by which the stakeholders, the bench and bar or the Malaysian community at large is affected;

     

    "improvement" means the degree to which the work involved improved techniques and structures or innovative legal rules or regulations;

     

    "innovation" means the degree to which the work involved original techniques and structures or innovative legal rules or regulations;

     

    "Malaysian element" means any or all of the following: (a) one of the law firms involved must be based in Malaysia; (b) one of the parties to the deal must be based in Malaysia; (c) the contract/deal was executed/completed in Malaysia; or (d) the contract/deal must, in any way, be related to Malaysia;

     

    "third-party award or recognition" includes that which is given by any award-giving organisation, public or private, other than ALB; and

      

    "work" includes any transactions/deals/projects completed, cases handled, disputes settled and other legal services provided within the organisation or otherwise.

      

    Part III

     

     CATEGORIES

     

    A.    Deal Categories

          (1) Specific Guidelines

     

    a.    A deal must have some Malaysian element. 

     

    b.    An organisation may submit up to three deals for every category below, and every deal submitted thereon must have a minimum financial value (MFV) of USD250 million:

     

    1.    Debt Market Deal of the Year;

    2.    Equity Market Deal of the Year;

    3.    Islamic Finance Deal of the Year; and

    4.    M&A Deal of the Year.

     

    c.    The winners of other deal categories, except Dealmaker of the Year, automatically become finalists for Malaysia Deal of the Year, and the finalist obtaining the highest score wins the award.

     

     

    (2) Criteria. The evaluation of deals will be based on the following factors:

     

    a.    Complexity;

    b.    Innovation/improvement;

    c.    Breadth;

    d.    Impact/significance; and

    e. Third-party awards/recognition.

     

     B.   In-House Categories

     

    1.    Banking and Financial Services In-House Team of the Year

    2.    Energy and Resources In-House Team of the Year

    3.    Insurance In-House Team of the Year

    4.    TMT In-House Team of the Year

    5.    In-House Lawyer of the Year

    6.    MIArb Award  Malaysia In-House Team of the Year

     

    (1)  Specific Guidelines

     

    a.    All in-house teams with physical office in Malaysia are qualified for any in-house categories.

     

    b.   In-house teams from industries other than banking, energy and resources, insurance and technology, media and telecommunications may nominate         their teams for Malaysia In-House Team of the Year.

     

    c.    The winners of other in-house categories, except In-House Lawyer of the Year, and the in-house teams referred to above automatically become finalists for Malaysia In-House Team of the Year.

     

    (2)  Criteria. The evaluation of entries for in-house categories will be based on the following factors:

     

    a.    Complexity;

    b.    Innovation/improvement;

    c.    Breadth;

    d.    Impact/significance; and

    e. Third-party awards/recognition (when applicable).

     

      C. Firm Categories

    1.    KLRCA Award Arbitration Law Firm of the Year

    2.    Banking and Financial Services Law Firm of the Year

    3.    Corporate Citizenship Law Firm of the Year

    4.   SCL Malaysia Award Energy, Projects and Infrastructure Law Firm of the Year

    5.    Intellectual Property Law Firm of the Year

    6.    Islamic Finance Law Firm of the Year

    7.    Labour and Employment Law Firm of the Year

    8.    Litigation Law Firm of the Year

    9.    Maritime Law Firm of the Year

    10. Real Estate Law Firm of the Year

    11. Malaysia Deal Firm of the Year

    12. International Deal Firm of the Year

    13. Managing Partner of the Year

    14. Malaysia Law Firm of the Year

     

    (1) Specific Guidelines

     

    a.    An international law firm may nominate for Arbitration Law Firm of the Year provided that, in the cases submitted as entries, the seat of arbitration was in Malaysia or the firm advised, represented or assisted a Malaysian party or parties in such cases.

     

    b.    Only Malaysian law firms are eligible to nominate for Litigation Law Firm of the Year, Malaysia Deal Firm of the Year and Managing Partner of the Year.

     

    c.    Only foreign law firms are eligible to nominate for International Deal Firm of the Year.

     

    d.    No MFV is required for deals submitted for Malaysia Deal Firm of the Year or International Deal Firm of the Year; nevertheless, the deals submitted for the latter category must have some "Malaysian element" as defined in Part II above.

     

    e.    The winners of other firm categories, except Managing Partner of the Year, automatically become finalists for Malaysia Law Firm of the Year, and the finalist obtaining the highest score wins the award.

     

     

    (2) Criteria. The evaluation of entries for firm categories will be based on the following factors:

     

    a.    Key hires/departures (when applicable);

    b.    Complexity;

    c.    Innovation/improvement;

    d.    Breadth;

    e.    Impact/significance;

    f.     Third-party awards/recognition;

    g.    No. of transactions completed (when applicable); and

    h.    Volume of completed transactions in USD (when applicable).

     

     

    Part IV 

    JUDGING PANEL

     

                The judging panel consists of the general and the special expertise panels. It is composed of approximately 30 reputable members from the legal academe, in-house teams, law firms, legal associations or business leagues, whose identities are kept confidential prior to the awarding ceremony.

     

                The panel of judges is given one week to evaluate the accomplishments of nominees based on a research summary provided by ALB. The judges choose the top three finalists for every category. A score allocated by a judge to a finalist with which or with whom he has an apparent conflict of interest is considered void.

     

                The finalist in every category who obtains the highest score wins.
