    Wong & Partners picked up five wins in the individual and firm categories, including the coveted Malaysia Law Firm of the Year gong, and Adnan Sundra & Low (ASL) landed five trophies in those categories at the ALB Malaysia Law Awards 2018.

    Additionally, Wong & Partners had three wins in the deal categories – including M&A Deal of the Year for S P Setia's acquisition of I&P Group – while ASL counted the Malaysia Deal of the Year (Saudi Aramco Integrated Development Project of PETRONAS) among its six deal awards.

    Notable individual winners on the night included Adrian Chee Meng Yang of ASL for Dealmaker of the Year, Datin Grace Yeoh of Shearn Delamore & Co for Managing Partner of the Year, and Wong Sue Wan of Wong & Partners for Woman Lawyer of the Year.

    On the in-house side, Datin Veronica Selvanayagy of AIA was named In-House Lawyer of the Year, while Maybank snapped up the Malaysia In-House Team of the Year award. Maybank also won the award for Banking and Financial Services In-House Team of the Year.

    Rodziah Zainudin, Head of Legal, Shell Malaysia

    Rodziah Zainudin, Malaysian, is Head of Legal, Shell Malaysia since 1 May 2017, after returning from Qatar on a 4-year assignment as Senior Legal Counsel of Qatar Shell GTL Limited. Prior to this role, Rodziah was Senior Legal Counsel, Downstream Regional Portfolio, providing primary legal support for Shell M&A transactions in Singapore, Pakistan, South Korea, Indonesia, Vietnam, China and Malaysia.  Concurrently, she was Company Secretary of Shell Malaysia since 2001 overseeing 37 companies within the Shell Malaysia group of companies.  Her portfolio in Shell Malaysia included Gas & Power Business and Corporate Finance.  Since 1 December 2017, she was appointed the President of Shell Women Action Network promoting gender balance in Shell Malaysia.

    Prior to joining Shell Malaysia, she practiced for 6 years in Zaid Ibrahim & Co and ZICO, Labuan and co-authored “Labuan Manual of International Business” in 1999.  Rodziah is the founder of RozaEdu4U since 2014 providing free Arabic and Quran lessons in her home state Melaka. She enjoys travelling with her two children and writes in her free time. 


     

    Carolyn  Chua, Associate General Counsel, South-East Asia & Korea, HP

    Carolyn Chua is the Associate General Counsel, South-East Asia & Korea in HP, with over 20 years of in house commercial and legal experience in the IT industry. She is based in Kuala Lumpur, Malaysia.

    Since joining HP in 2000, her work experience and portfolio has included commercial, transactional contracts work, with focus on cross border transaction and large deals support. Given the constant change in corporate America landscape, she has successfully seen through 5 mergers and acquisitions activities in HP. She is responsible in driving corporate compliance and ethics in HP, ensuring corporate excellence and compliance in HP’s commitment of products services to its corporate clients; this ensures HP continues to set its strong mark in the IT industry.

    She continues to balance legal advice with strong commercial acumen and strategic insights to align with the high growth of business in HP while equally enjoying the fast pace and intellectually stimulating everyday corporate work. She places high emphasis on managing and harnessing employee diversity and talent, developing and empowering employees. She is a firm believer in growth mindset; to always learn, improve and in keeping current. 


     

    Sudharsanan Thillainathan, President, The Malaysian Institute of Arbitrators 

    Sudhar is a Senior Partner in the Dispute Resolution Practice of Messrs Shook Lin & Bok and he also heads the Firm's Tax as well as Competition and Anti-Trust Law Practices. Sudhar is listed as a market leading/leading lawyer in his fields of practice in various publications and is recognised as an expert in Commercial Arbitration by Expert Guides. He serves on the panel of arbitrators and adjudicators of the Kuala Lumpur Regional Centre for Arbitration. He is the current President of the Malaysian Institute of Arbitrators, the national body for arbitration in Malaysia.

     


     

        

    Jeffrey Tan, Executive Director - Group Legal, Tropicana Corporation Berhad

    Jeffrey Tan heads Group Legal at Tropicana Corporation Berhad and brings with him considerable experience in advising, negotiating, structuring and reviewing corporate, conveyancing and commercial transactions. He has successfully structured and completed numerous large landbank acquisitions for the purposes of investment and development in Malaysia and the Asia Pacific. He is a seasoned general counsel who provides a comprehensive in-house legal service to companies within the complex group structure with many different work streams and operating in various countries.

    He was formerly a Partner at Azmi & Associates, where he was also a registered Trade Mark Agent and a licensed foreign lawyer in Singapore. Prior to joining Azmi & Associates, he was a Partner at Raslan Loong, a law firm with representative offices in Singapore and Mannheim. He has also authored many articles and has presented many legal papers at seminars and conferences.

    Jeffrey Tan holds the degrees of Bachelor of Laws and Bachelor of Commerce (Accounting) from Monash University, Australia and Master of Science (Information Technology in Business) from University of Lincoln, United Kingdom.

    ELIGIBILITY 

    How do I know if I am eligible to make a submission? 
    We highly encourage all firms, individuals and in-house teams to submit, as we have numerous award categories to choose from. We welcome both past participants and newcomers to join the submission for the awards. The full list of award categories and nomination forms can be found at legalbusinessonline.com/awards/Malaysia-law-awards-2018. 

    Is self-nomination permitted?
    Yes, we accept self-nominated submissions. We also accept third-party submissions, should you wish to nominate an external party or vice versa.

    Is there a fee required to make a submission in the law awards?

    No, there is no fee payment required for you or your firm/team to make a submission. 
     

    TIMELINE OF EVENTS

    When will the finalists and winners be announced?
    The shortlist of finalists will be released around 4-8 weeks prior to the awards ceremony. The winners will be exclusively announced at the awards ceremony on March 22, 2018 in Kuala Lumpur.

    When do the submissions open? When is the deadline to submit?
    The submissions will open in December. The final deadline to submit will be in February. For any questions relating to submissions and deadlines, please contact Yvonne.Lau@thomsonreuters.com.

     

    NOMINATION PROCESS AND ASSESSMENT 

    How are the finalists chosen?
    Asian Legal Business will compile all of the submission entries, and the ALB editorial and research teams will extensively review each submission to ensure the criteria are met in order to advance to the shortlist of finalists. We stress that this process is fair, impartial and not subject to external influences. 

    How are the winners chosen? 
    Once the shortlist of finalists have been announced, an independent judging panel will review and select their top three choices for the award categories they are assigned to. The scores for each award category will be tabulated, and the individual/firm/team with the highest score will be announced as the winner. 

    Who will be on the judging panel for the ALB Malaysia Law Awards 2018? 
    There will be an independent judging panel of about 40 senior and expert legal industry leaders to review the submission materials. The judging panel will be selected on the basis of their expertise and knowledge, and will be comprised from various sectors to correspond to the diverse list of award categories. A partial list of judges’ names will be released prior to the awarding ceremony, and the remaining judges will be revealed on the evening of the awards. 

    What will my contact information/my client’s information be used for?
    All contact information provided will not be disclosed to external parties; and will only be seen by our ALB research team and the judges panel. We keep the information on record internally, in case we need to contact you or your client regarding any questions or discrepancies in the submission form. 

    Where will my name/firm name/team name be published if we are a finalist or winner?
    As a finalist and/or winner, your firm/team/individual name will be published in Asian Legal Business awards materials and print magazine. For more information, please contact us.

    Is my submission confidential?
    Any information you submit will only be reviewed by the ALB team and independent judging panel, whose names will be published. The material submitted will only be disclosed to the above; if there is any information that is strictly confidential, please mark clearly on the nomination form. Though we do our best to maintain the security of the information you provide, any information you transmit to us is done at your own risk and Thomson Reuters is not responsible for any unauthorized transmission of information.

    Assalamualaikum, Salam Sejahtera and a very good evening to all the distinguished guests, judges, Honourable Jurists - Mr. Ranajit Dam, Managing Editor, Legal Media Group, Thomson Reuters; Mr. Thavakumar Kandiahpillai, President of the Malaysian Corporate Counsel Association and Mr. Sudharsanan Thillainathan, President of the Malaysian Institute of Arbitrators.
     

    Ladies and Gentlemen,
     

    It is a great pleasure for me to be here to meet and honour the noble jurists who have contributed as well as those who are contributing towards the Rule of Law.
     

    Rule of Law in democratic nation generally means the State is governed by laws which are not arbitrary and are fairly applied and enforced.  Various authors and jurist have defined Rule of Law according to the ideals they are intended to achieve.  What is essential to note is that arbitrariness in formulating the law or the application of the law is an antithesis to the concept of Rule of Law as advocated by almost all great jurists.  Arbitrary formulation of the law and its application is an anathema to the Rule of Law and is often referred to as Rule by Law which basically relates to an authoritarian state.  Authoritarian states do not subscribe to democratic values as well as notion of fairness and justice of universal nature.  Thus, failure to subscribe to the Rule of Law entails oppression on humanity itself.

     

    The application of Rule of Law is not an easy subject.  Day to day legislature, executives, judges, lawyers, businessmen, public, etc. be it public or private law, are often struggling to understand the scope and parameters of the Rule of Law and its application.  To compound the problem, the Rule of Law and its application in all nations are not one and the same.
     

    For example, the Rule of Law in Malaysia relates to Constitutional Supremacy and the Rule of Law in England relates to Parliamentary Supremacy.  The distinction in its application and the end result in public law field is not one of an apple and orange but a marble and pumpkin.  English cases which we have often relied on, may not be relevant though there may be commonality when it relates to private law.
     

    The concept of Rule of Law today dictates every person’s life, undertaking as well as fate.  A breach of the Rule of Law may lead to civil or criminal liability.
     

    Rule of Law anchored on the concept of accountability, transparency and good governance often lead to a democratic, civilized and progressive nation, as opposed to Rule by Law.  Rule by Law is a concept often raised by misguided jurists in democratic nations to undermine the concept of the Rule of Law with a purpose to lean towards an authoritarian state.  The conflict between Rule of Law and Rule by Law is often been a subject matter which has been considered in judicial making process in many jurisdictions including England.
     

    The beauty of the application of Rule of Law which is based on accountability, transparency and good governance is that it can change a nation perceived to be a desert to an oasis.  The danger of application of Rule by Law is that it can destroy a nation which is perceived to be an oasis to a desert.
     

    In most civilized jurisdiction, having a constitution and subscribing to Rule of Law, requires the judiciary to be the supreme policeman to ensure the Constitutional provision are upheld by dictates of Rule of Law which promotes accountability, transparency and good governance.
     

    To ensure Rule of Law is maintained, jurists must continuously do research as well as publish critical articles, books, etc. to guide the nation as well as administration of justice.  Malaysian jurists in this respect have done very well as this is reflected in the recent Federal Court judgment of Indra Gandhi Mutho v Pengarah Jabatan Agama Islam Perak & Ors and Other Appeal [2018] 3 CLJ 145, where Rule of Law related to Constitutional Supremacy was affirmed as opposed to Rule of Law related to Parliamentary Supremacy.
     

    It is heartening for me to note that the renowned law publisher, Thomson Reuters, as a global contribution to sustain Rule of Law, identifies the top talents in law and rewards them for their outstanding work.  The awards given by Thomson Reuters plays a role in shaping the legal profession to assist in the administration of justice.
     

    To the participants and award winners, please accept my heartfelt appreciation, congratulation and salutation for the remarkable contribution you have made towards the study, practice and administration of justice.
     

    It is my judgment tonight that any service to the Rule of Law to sustain accountability, transparency and good governance is a service to humanity itself.

    *YA Datuk Dr. Haji Hamid Sultan bin Abu Backer, Judge of the Court of Appeal, Malaysia and Honorary Visiting Professor of the Damodaram Sanjivayya National Law University (DSNLU), India, is a barrister and a fellow of the Chartered Institute of Arbitrators.  He is a graduate in Economics and an honours and masters degree holder from the University of London in Insurance, Shipping and Syariah Law.  He holds post-graduate diplomas in Islamic Banking and Finance and in Syariah Law and Practice from the International Islamic University Malaysia.  

    He was a member of the Malaysian Bar Council for more than six years and has served as chairman in various committees. He has been invited as a visiting scholar of the University of Sheffield in United Kingdom and had spoken on enforcement of foreign arbitral awards at the Chartered Institute of Arbitrators, London as well as City University of London; Attorney General's Department, Sri Lanka; The Tamilnadu Dr. Ambedkar Law University, India; DSNLU Visakhapatnam, India; University of Leeds, England; Maison du Barreau de Paris, Paris; and EBS Universität Wiesbaden, Germany. He had also spoken on arbitration clause in Islamic finance facilities at Hamad Bin Khalifa University, Qatar. He participates in various activities of universities as an examiner of PhD thesis, external examiner and guest speaker. He had written on various subjects, inclusive of Civil Procedure, Criminal Procedure, Evidence, Conveyancing, Islamic Banking, International and Domestic Arbitration and other areas of commercial law. His works enhance the libraries of law firms and the chambers of judges. His books are used not only as textbooks in all institutions of higher learning offering law, but also used as reference by those involved in the practice and administration of law in Malaysia. His doctorate thesis was on Civil Procedure and Justice.  He has written about one thousand judgments which cover most areas of law.
