Asian Legal Business in March 2016 will host the highly-acclaimed Hong Kong Anti-Corruption Forum for the third year running, a forum that will bring together legal, business and government leaders and experts to examine the most pressing trends in Hong Kong and China’s anti-corruption regime.

As both Hong Kong and China increase their activity in the anti-corruption sphere, what are the most compelling issues that legal and business communities should know and how should they respond? Simon Peh
Commissioner, Independent Commission against Corruption (ICAC) 

Mr Peh joined the Hong Kong Immigration Department as an Immigration Officer in April 1978 after graduating from the Chinese University of Hong Kong. He studied public policy and administration at the Graduate School of Public Policy at UC Berkeley in 1991-92. He attended the Royal College of Defence in London in 2001 and was awarded a Master Degree in International Relations by the King's College London. He was promoted to Director of Immigration in April 2008 after serving various branches in the Department. He retired from the Immigration Department in March 2011 and proceeded onto his pre-retirement leave. On 1 July 2012, he was appointed by the Central People's Government, People's Republic of China, as Commissioner of the Independent Commission against Corruption of the Hong Kong Special Administrative Region. Mr Peh was awarded the Immigration Distinguished Services Medal and the Silver Bauhinia Star Medal by the Chief Executive of the Hong Kong Special Administrative Region in 2006 and 2011 respectively. 

Wesley Wong
SC, Solicitor General, Department of Justice, Hong Kong 

Wesley Wong read law in Hong Kong and was called to the local bar in 1993.  He was Deputy Director of Public Prosecutions before serving as the 5th Solicitor General of the Hong Kong Special Administrative Region since September 2015.  He spends his entire legal career at the Department of Justice, having been posted to different parts of it (including as head of the Commercial Crime and Corruption Unit) and undertaking both civil and criminal work before the courts or otherwise.  He has been an accredited mediator since 2009 and took silk in 2013.

Andy Meehan
Anti-Corruption Counsel, Asia-Pacific, Morgan Stanley 

Andy leads the APAC legal advisory team for Morgan Stanley’s Global Financial Crimes division. Andy advises Morgan Stanley’s Asia-based entities on anti-corruption, global economic sanctions, and anti-money laundering laws and regulations as they impact Morgan Stanley’s business operations, transactions, and clients. He is also is an experienced litigator, having previously focused his practice on representing clients involved in civil and criminal enforcement matters brought by the U.S. government. Prior to becoming a lawyer, Andy was a Special Agent with the U.S. Air Force Office of Special Investigations, where he specialized in the detection and investigation of terrorism, espionage, and counterintelligence operations.

Kyle Wombolt 
Partner and Global Head of Corporate Crime and Investigations

Kyle is the global head of HSF's corporate crime and investigations practice. Based in Hong Kong, he has 15 years of experience in Asia and has led investigations and compliance projects in more than 40 countries worldwide. He focuses on mult-jurisdictional anti-corruption, regulatory, fraud and accounting investigations, as well as trade and sanctions issues involving major global and regional corporates. He has extensive experience in dealing with a broad group of government agencies and regulators in the key jurisdictions in Asia-Pacific, Europe and the United States. 

Kyle also has a broad range of experience implementing anti-corruption compliance programmes for investment banks and multinational companies. He regularly advises clients on corruption risks associated with a wide range of transactions, including IPOs, mergers and acquisitions and joint ventures. 

Simon Leung 
Head of Anti-Money Laundering, China CITIC Bank International 

Simon is presently the Head of AML of China CITIC Bank International. He has over 15 years of AML/CFT experience that was attained from the police and banking industry. He was the officer-in-charge of the Joint Financial Intelligence Unit (JFIU) for 2 years and a qualified AML Law Enforcement Expert who had represented Hong Kong and the Asia Pacific Group on Money Laundering to participate in the IMF-led mutual evaluation assessment on Cook Islands AML Regmie in February 2004. Before joining China CITIC, he was the Regional Head of ML Investigation & Analytic, Asia Pacific, HSBC. He holds a Master Degree of Social Science in Public Policy and Management. 

Vasu B. Muthyala
Principal, Kobre & Kim 

Vasu Muthyala focuses on cross-border regulatory investigation and compliance, with an emphasis on anti-corruption/FCPA and securities/accounting fraud issues in Asia. His international experience with matters relating to government investigations involving the US, Hong Kong, China, Korea, India, and UK among others, have garnered awards from the National Asian Pacific American Bar Association and the Global Investigations Review. Mr Muthyala spent over a decade with the US Government as a senior prosecutor in the Fraud and Public Corruption section of the US Attorney's Office for the District of Columbia and as an enforcement attorney at the US Securities and Exchange Commission. 

Marcus Crachi
Supervising Counsel, Telstra International

Marcus Crachi is a senior lawyer with Telstra - a leading telecommunications and technology company with over 36,000 staff worldwide. As part of his role, Marcus manages a team of talented lawyers who support Telstra's operations internationally, including its compliance functions outside Australia. He has a passion for navigating complex and strategic issues, including bribery and corruption issues associated with mergers and acquisitions in developing countries. Before joining Telstra's international legal team and moving to Hong Kong, Marcus supported Telstra's retail consumer business and advertising business in Australia and also worked as a solicitor at King & Wood Mallesons. 

Gero Schreiber
Head of Legal and Compliance, Siemens

Gero Schreiber is the Head of Legal and Compliance for Siemens in the area of banking and finance covering the entire APAC region. In his role, he is responsible for all banking and finance related legal and compliance topics of the Siemens group of companies, including its fniancing arms Siemens Bank and Siemens Financial Services. Prior to joining Siemens, Gero worked as a corporate and finance lawyer for major international law firms in London and Germany. He earned law degrees from universities in England, Germany and France and is qualified to practice law in England and Germany.

With more than 20 years of Asia Pacific hospitality industry experience, Yibing Mao brings invaluable legal and business expertise to Marriott International’s fastest growing region. Ms. Mao is Chief Legal Counsel & Senior Vice President of Asset Management – Asia Pacific, her most recent role since joining Marriott International in 1996. David Getzinger
Senior Managing Counsel, Asia-Pacific, Intel Capital

David Getzinger is a California-trained lawyer with nearly twenty-five years' experience in the venture capital and private equity industries in Silicon Valley and, since 1994, in Asia. Dave serves as Asia-Pacific regional counsel for Intel capital, the corporate venture and strategic investment arm of Intel Corporation, and together with his team supports Intel Capital investments, portfolio and compliance matters in China, India and elsewhere in the region. Dave holds degrees from Stanford University and the University of California at Berkeley and speaks English and Mandarin Chinese.

 

Greg Hallahan
Managing Director, FTI Consulting

Greg Hallahan is a Managing Director in the Global Risk and Investigations practice of FTI Consulting and is based in Hong Kong. Prior to moving to Hong Kong in 2013, Greg spent over a decade working in mainland China. These engagements have stretched across a variety of industry sectors, in particular encompassing financial services, mining and manufacturing. In addition to developing a portfolio of clients across the region, Greg is experienced in leading and conducting a wide variety of business intelligence, due diligence and corporate investigations throughout Asia Pacific. Greg holds a M.A. in Psychology from Edinburgh University, Scotland.

Ms Chhoa joined Hang Lung Properties Limited as Company Secretary, General Counsel and Assistant Director — Corporate Affairs in August 2011, where she oversees the legal, company secretarial and human resources and training functions of the Group in Hong Kong and Mainland.  Prior to joining Hang Lung, she was head of the legal department and company secretary of two other companies listed on The Stock Exchange of Hong Kong Limited for a number of years. Ms Chhoa is a solicitor qualified to practice in Hong Kong.  She holds a Master of Business Administration degree from The Chinese University of Hong Kong and a Bachelor degree in Law from The University of Hong Kong. 

Andrew Bruce
SC, Barrister at Law, Gilt Chambers

Andrew Bruce, SC is a barrister in private practice in Hong Kong at Gilt Chambers. He specialises in commercial crime and corporate fraud, money laundering and corruption cases. He also specialises in cases involving criminal asset recovery and forfeiture. Mr Bruce was admitted to practice in Australia in 1977 and was made Senior Counsel in 1996. He is the author of Criminal Procedure: Trial on Indictment and the co-author, with Gerard McCoy, SC of Criminal Evidence in Hong Kong. Andrew Bruce was, in another life, counsel in the Department of Justice.

Dr Sven-Michael Werner is a Partner in Bird & Bird's international corporate group based in Shanghai. He has over 12 years of experience in practicing law in China. Richard Keady

Richard leads Bird & Bird’s dispute resolution practice in the Asia Pacific region. Pattie Walsh

Pattie is a partner in our International Employment Group who co-leads our Asia-Pac Employment Practice. She is widely regarded as one of the leading employment lawyers in Asia. Pattie's practice covers both contentious and non-contentious employment law issues providing a 'one stop shop' for her international clients. Dean Ward

Dean has been with Thomson Reuters for just under 10 years and is currently the Head of Risk Sales Specialists for Hong Kong and North Asia. He started as a researcher before moving into a client facing role with World-Check before the acquisition by Thomson Reuters, when he was asked to head up their due diligence business across Asia Pacific. He has worked with some of the world's largest banks, software companies, oil companies and pharmaceutical companies assisting them with their Anti-Money Laundering, Anti-Fraud, Pre-IPO, M&A and KYC due diligence, and helping them identify and manage compliance and regulatory risks.

Chiann Bao
Secretary General, Hong Kong International Arbitration Centre 

Chiann Bao serves as Secretary-General of the Hong Kong International Arbitration Centre, most recently ranked by an international arbitration survey as the most improved institution over the past five years as well as the most institutions used outside of Europe.  In the capacity of Secretary-General, Chiann functions as the chief executive officer of the HKIAC and oversees the administration of a full range of ADR support services.  She is a Councillor of the International Federation of Commercial Arbitration Institutions (IFCAI).  In addition, Chiann serves as a board member of the Practical Law Company, the Association of Corporate Counsel’s International Advisory Board, the Asian Dispute Review’s Editorial Board, and the NYIAC Board of Advisors.  Chiann is an adjunct professor at Hong Kong University.  A New York qualified lawyer, Chiann practiced at an international law firm in New York before joining the HKIAC in 2010. 

Monica Yu
Executive Director, Hong Kong Business Ethics Development Centre (ICAC) 

Ms Yu joined the Community Relations Department of the Independent Commission against Corruption (ICAC) of the Hong Kong Special Administrative Region in 1988. Throughout the years, Ms Yu has taken up different positions at headquarters such as the Centre of Anti-Corruption Studies, the Management and Strategy Office and in various regional offices. She has been responsible for coordinating the planning and implementation of corruption prevention strategy for different sectors in Hong Kong, including the busniess sector, youth and district organisations, etc. Ms Yu currently heads the Hong Kong Business Ethics Development Centre to promulgate business ethics and anti-corruption messages to local and overseas community.

 

 

Chao Xi
Professor of Law, Assistant Dean and Director of LLM Programmes, Chinese University of Hong
Kong

Chao Xi is Professor at the Faculty of Law, The Chinese University of Hong Kong, where he concurrently serves as Assistant Dean (Graduate Studies) and Director of the Faculty’s highly successful Master of Laws Programmes. He also directs the Chinese Law Program of the Hong Kong Institute of Asia-Pacific Studies. Professor Xi specializes in comparative corporate law, securities regulation, and financial regulation. His research has received significant funding support from the Hong Kong SAR Government Research Grants Council, the PRC Ministry of Education, and the Sumitomo Foundation. Professor Xi is a Member of the Chartered Institute of Arbitrators (CIArb), UK, and he has regularly been engaged by law firms, multinationals, and government departments and agencies as an expert.
