Jimmy Yim, SC Chairman, Drew & Napier Jimmy Yim, SC is the chairman of Drew & Napier and was the managing director of Singapore’s most celebrated dispute resolution practice group for 15 years. With an impressive legal career spanning nearly four decades, Yim has earned a reputation as a leading expert in dispute resolution, arbitration, and litigation. His expertise extends to various practice areas, including infrastructure and construction, investigations and crisis management, and telecommunications, media, and technology. One of Jimmy’s notable cases involves his representation of Wang Xiaopu, a wealthy PRC individual, against Dr. Goh Seng Heng and subsequently against his family members, to chase a S$40 million claim ($28.50 million). The cases began in 2015 and were fought through 2023 involve fraudulent misrepresentation in an investment deal. Yim, alongside his team, has successfully navigated the legal complexities of the case, securing a favourable judgment from the Singapore High Court and Court of Appeal and subsequently pursuing the fruits of the litigation through the family assets, which Yim argued were fraudulently disposed of by Dr Goh to evade creditors. In addition to his expertise in commercial litigation, Yim has extensive experience in arbitration matters. He represents clients such as DyStar Global Holdings, a prominent dye company, and Daelim Industrial Company Limited, one of Korea’s leading chaebols. In the case of DyStar, Yim and his team have achieved significant victories before the Singapore International Commercial Court (SICC), High Court and the Singapore Court of Appeal. In Daelim Industrial’s case, Yim’s expertise in cross-border construction deals and arbitration has been instrumental. Despite a decade-long arbitration process and multiple court applications, Yim’s strategic approach and strong advocacy have resulted in a favourable outcome for his client. Daelim’s liability for damages has been significantly reduced to nominal damages of approximately $6,661. Throughout his career, Jimmy Yim has demonstrated exceptional legal acumen, complete commitment to client’s causes and a deep understanding of complex disputes. He is highly regarded for his ability to handle highvalue and technically challenging cases, including those involving energy projects, fraud investigations, and jointventure contracts. His expertise and track record of success have earned him recognition in all prominent legal publications. Can you share some of your most notable practice highlights from the past year? What were some of the key cases or achievements that stood out for you as a disputes lawyer? I am a disputes lawyer specializing in disputes including commercial and company disputes, civil fraud investigations of listed companies, insolvency, enforcement of securities, and employment disputes. I have also represented corporate clients across a wide spectrum of industries, including companies, banks and individuals navigate complex cross-border disputes. In court or during arbitration proceedings, I have successfully obtained interim relief, including injunctions, on behalf of his clients numerous times against shareholders, directors and debtors for breach of agreement or fiduciary duties, and eventually obtaining final judgements/awards. I got extensive litigation experiences including representing a well-known PRC securities firm to settle a private bond dispute of over US$ 25,000,000 including enforcing HK Listco shares as charged securities, representing a wellknown PRC securities firm to act against an international bank for a basket bond product investment dispute of over US$ 63,000,000 and also representing 1 of the 5 biggest PRC banks to claim for repurchase of subscribed shares worth over HK$ 200,000,000 under an offshore fund subscription agreement and debt of over HK$ 300,000,000 under a facility agreement etc. What guiding principles or strategies do you employ in your cases to effectively represent your clients and navigate the intricacies of the legal system? I firmly believe that effective representation requires a combination of legal expertise, strategic thinking, and strong communication skills. One of the guiding principles that I employ in my cases is to always put my clients’ interests first. This means taking the time to understand their needs and developing a strategy that is tailored to their specific situation. In addition, it is important to be proactive and responsive in our communication with clients, keeping them informed of developments in their case. What have been some of the evolving trends and developments in the disputes space in your jurisdiction? How do you stay ahead and ensure success for your clients? Hong Kong is hailed as an international arbitration hub because of its independent judiciary and unique status as a bilingual common law jurisdiction. Disputes space in Hong Kong so far has not been impacted by political developments in previous years. To stay ahead to the trend, we need to stay up-to-date on legal developments including the changes of laws and regulations as well as new legal precedents which help us to anticipate potential issues for our clients.
